Terms of Use

These terms govern the use of the Mudano platform: apps, web dashboard, real estate agency websites, and this website. By creating an account or using the platform, you agree to them. The handling of personal data is described in the Privacy Policy.

1. The service

Mudano is a software platform for real estate agencies, with features for rental management, sales, client communication (including WhatsApp), scheduling, and property inspection. The features available to each agency depend on the subscribed plan. The platform is in its launch phase and may gain, change, or lose features over time.

2. Account and access

• You must provide accurate information and keep it up to date.
• Your account is personal. Do not share your password or verification codes.
• The same person may be linked to more than one agency with different roles in each; what you can see and do depends on your active role.
• Notify us immediately if you suspect unauthorised use of your account.

3. Agency responsibilities

• The agency is responsible for the data it registers on the platform and for the legal basis for processing its clients' data.
• By connecting WhatsApp, the agency must comply with WhatsApp's and Meta's terms and policies, obtain opt-in consent from contacts before sending messages, and honour opt-out requests.
• The agency decides who on its team has access and with which role, and is accountable for how those individuals use the platform.
• Contracts, inspection reports, and other documents generated on the platform are the responsibility of the parties that execute them; Mudano provides the tool.

4. Permitted use

It is prohibited to use the platform to:

• send unsolicited bulk messages (spam) or illegal, offensive, or misleading content;
• process personal data without a legal basis or in violation of the LGPD;
• attempt to access other agencies' or individuals' data, circumvent security controls, or interfere with the operation of the service;
• copy, resell, or reverse-engineer the platform.

We may suspend or terminate access for anyone who violates these terms.

5. Availability

We work to keep the platform available and secure, but interruptions may occur for maintenance, updates, or due to failures of third parties such as cloud, messaging, and telecommunications providers.

6. Pricing and payment

Commercial conditions, including price, payment method, and term, are those set out in the agreement between Mudano and the agency. Individuals accessing the platform as clients of a real estate agency do not pay Mudano for use.

7. Intellectual property

The platform, the Mudano brand, and its content belong to Mudano. Data registered by the agency remains the agency's property.

8. Limitation of liability

To the extent permitted by law, Mudano is not liable for business decisions made by agencies and their clients, for information registered by third parties on the platform, or for damages caused by failures of third-party services beyond its control. Nothing in these terms limits rights guaranteed by the Brazilian Consumer Protection Code where applicable.

9. Termination

You may close your account at any time in the app, under My account, or request data deletion as described on the Data Deletion page. Data that the law requires to be retained will be kept for the statutory period.

10. Changes to these terms

We may update these terms. The date of the last update is shown at the top of the page and, for significant changes, we will notify users through the platform.

11. Governing law and contact
